Big Relief for Small Units in Madhya Pradesh: No Fire NOC up to 21,500 sq ft, but Annual Fire Audit for All

Under Madhya Pradesh's new fire law, fire officials in Indore said only industrial units with more than 2,000 sq m (about 21,500 sq ft) of built-up area need a fire NOC. The annual fire audit, due by 30 June, still applies to every unit.

Good news for small factories in Madhya Pradesh. At a workshop for industrialists in Indore, fire officials said that a fire NOC is compulsory only for industrial buildings with more than 2,000 square metres (about 21,500 sq ft) of built-up area. Smaller units fall outside the fire NOC requirement, which saves them an application, fees and a renewal cycle.

The relief has a limit, though. Officials also said that every industrial unit, small or large, must get a fire audit done under the new law. So small units can skip the NOC, but not the fire safety arrangements.

If you run a food, beverage or packaged drinking water plant in Madhya Pradesh, here is what has been reported so far and what to do now.

Who gets the exemption, and who does not

Industrial unitFire NOCAnnual fire audit
Built-up area up to 2,000 sq m (about 21,500 sq ft)Not required, as reportedRequired
Built-up area above 2,000 sq mRequiredRequired

Many packaged drinking water plants, especially 20-litre jar units and small bottling lines, have a built-up area below 2,000 sq m, so a good number of them should benefit. Measure carefully: the figure is built-up area, so mezzanines, stores and sheds count.

The new law and rules

The Madhya Pradesh Fire and Emergency Services Bill, 2026 was passed by the state Assembly in July 2026. As reported, it became the Madhya Pradesh Agnishaman Evam Apatkalin Sevayen Adhiniyam, 2026 after the Governor's assent. The Dainik Bhaskar report on the Indore workshop described the Act as applicable from 5 September 2026.

The Madhya Pradesh Fire and Emergency Services General Rules, 2026 were then notified by the Urban Development and Housing Department. Dainik Jagran (English) reported the Gazette notification as dated 12 October 2026.

What the rules require, as reported

  • Annual fire audit: building owners or occupiers must submit a fire safety audit report every financial year by 30 June.
  • Online declaration: owners must also file a yearly self-declaration on the status of fire safety and evacuation arrangements.
  • Late filing: a show-cause notice is issued. Continued non-compliance can lead to cancellation of the fire safety certificate.
  • Validity: a fire safety certificate is generally valid for 5 years and a fire plan approval for 3 years. Dainik Jagran reported that renewal must be applied for at least 60 days before expiry.

At the Indore workshop, held at the Association of Industries Madhya Pradesh (AIMP) hall, industry representatives asked for two years to bring existing units up to the new standards. No relaxation has been officially notified as far as we could find, so plan on the rules applying as written.

What this means for water plant owners

A typical packaged drinking water plant has a production hall, a preform and bottle store, a corrugated box store, a DG set, a boiler or shrink tunnel in some cases, and electrical panels. Cartons and PET stock make storage areas a real fire load. Practical steps for units in Madhya Pradesh:

  • Measure your total built-up area, including mezzanines and stores, to see whether you cross 2,000 sq m.
  • If you are below it, keep the measurement and your building plan on file, as proof that the NOC does not apply.
  • If you are above it and have no fire NOC, start the application now. If you have one, renew at least 60 days before expiry.
  • Small or large, plan for the annual fire audit: extinguishers of the right type and count, refilling and hydro-test records, clear exits, emergency lighting, and trained staff.
  • Keep a fire safety file with layout drawings, equipment list, maintenance logs and mock drill records, ready for the 30 June audit.
  • Check that the agency doing your audit holds a licence under the new rules.

Plants outside Madhya Pradesh follow their own state's fire laws. Our general fire NOC guide explains the usual process, and the packaged drinking water plant approval checklist shows where fire NOC fits among FSSAI, CGWA NOC and CTE/CTO.
