I Am a Co-Packer for a Packaged Drinking Water Brand. Do I Need EPR Registration?

Why a contract packer of branded water needs its own EPR registration, and how obligations split between the co-packer and the brand owner.

Yes, a co-packer of a branded packaged drinking water needs its own EPR registration. Since the Plastic Waste Management (Amendment) Rules, 2024, the legal definition of "producer" includes anyone doing contract manufacturing with plastic packaging for a brand owner.

Many co-packers still believe EPR is only the brand's job: the brand's name is on the bottle, so the brand handles the plastic. That was a reasonable reading a few years ago. It is no longer safe, and the gap can cost you orders, consents and penalties.

What the law says

The Plastic Waste Management (Amendment) Rules, 2024, notified in March 2024, widened the definition of "producer". It now covers persons engaged in contract manufacturing of products using plastic packaging, or similar arrangements, for a brand owner.

A co-packer of branded water does exactly that. You fill water into PET bottles and jars, cap them, label them and shrink-wrap them for the brand. Many co-packers also blow the bottles from preforms in-house, which makes them a producer of plastic packaging on both counts.

EPR registration, in turn, is mandatory for every producer, importer and brand owner (PIBO) under the Plastic Waste Management Rules, 2016. Our EPR guide for packaged drinking water covers the full set of obligations.

Why a co-packer needs EPR: five reasons

  1. You are a "producer" in law. Contract manufacturing for a brand owner is now inside the definition, so registration is not optional.
  2. Your brand owner needs your data. The brand files returns on the plastic it places on the market. It needs matching figures from you: bottles, jars, caps, labels and shrink wrap, plant by plant.
  3. Pollution Control Boards are checking. State boards inspect plants and some have started asking units for EPR proof alongside CTE and CTO. A co-packer with no EPR number has nothing to show.
  4. Brand contracts demand it. National brands increasingly make EPR registration a condition of the co-packing agreement and of vendor onboarding. No registration can mean no new orders.
  5. Penalties reach you, not just the brand. If your plant is a producer and is unregistered, environmental compensation and action under the Environment (Protection) Act, 1986 can fall on your company.

Who carries which obligation

Registering does not mean the co-packer pays the brand's whole EPR bill. The brand owner still carries the main obligation for packaging sold under its brand. The co-packer's job is to be registered, report accurately and keep records that match the brand's.

ObligationBrand ownerCo-packer (producer)
EPR registration on the CPCB portalYesYes
Recycling target and EPR certificates for branded packsMain obligationUsually covered by the brand; confirm in your agreement
Reuse targets for 20-litre jarsYesSupports with jar issue and return records
Recycled PET contentShared; set out in the contractUses the rPET the brand specifies, from FSSAI-compliant suppliers
Plastic quantity recordsConsolidates across co-packersKeeps plant-wise records of bottles, jars, caps, labels and wrap

The key point is the contract. Write down who buys the EPR certificates, who meets the recycled-content target and how quantities are reported, so the same plastic is not counted twice or missed.

Co-packer EPR checklist

  • Register on the CPCB EPR portal as a producer
  • Keep KYC ready: PAN, CIN, GST, authorised person's PAN and Aadhaar, board resolution
  • Keep your CTE and CTO valid; producers must show consents for their plants
  • Record plastic quantities per brand: preforms, bottles, jars, caps, labels, shrink wrap
  • Get the brand owner's EPR registration number and quote it in your records
  • Add an EPR clause to the co-packing agreement: who buys certificates, who meets recycled-content targets, how data is shared
  • Keep jar issue, return and refill records if you handle 20-litre jars
  • File your annual return by 30 June and renew registration on time
